Scope of application
Sales contracts concluded through e-commerce between The One Off store and the consumer shall be governed by the following General Terms and Conditions of Sale.
Please read these Terms, our Cookie Policy, and our Privacy Policy carefully before using this website. By using this website or placing an order through it, you agree to be bound by these General Terms and Conditions of Sale and by our Privacy Policies, so if you do not agree with all the provisions set out in the General Terms and Conditions of Sale and the Privacy Policies, you must not use this website.

PURCHASE PROCESS
How to place an order
The website user may browse the web store and fill the shopping cart without needing to be registered. Only to complete the purchase will it be essential to provide certain mandatory information in order to access the order shipping details.
To find the item you want, you can browse through all the sections of our Website. By clicking on any of the sections, you will find a wide variety of items, their description, available sizes, and the corresponding price.
Once you have selected the item you want, you will only need to click the “ADD TO CART” button. When a product is added to the shopping cart, you will automatically be able to view the full status of your bag. At that point, you may choose to continue shopping or process your order. If you continue shopping, your shopping bag will remain visible at all times in the upper right part of the screen. By clicking there, you will be able to view all the contents of the shopping bag and even modify it.
Once the items you wish to purchase have been selected, and the necessary information for shipping has been provided, you will access a form with all the information regarding the shipping and payment options. Once a purchase order has been received, The One Off will immediately send confirmation of the completed sale to the email address provided.

Conclusion of the contract
By clicking the “complete purchase” button, you make a binding declaration of intent by which you accept the conclusion of the order and undertake to pay for it. You will then receive acknowledgment of receipt of your order, confirming the conclusion of the contract.
Technical means for correcting errors
If you detect that an error has occurred when entering your personal data during your registration as a user of this website, you may modify it in the “My Account” section.
In any case, you may correct errors related to the personal data provided during the purchase process by contacting customer service

ECONOMIC CONDITIONS
Price
For customers within the European Union (EU), the prices shown are final prices. They include the relevant taxes, in particular VAT, and all other price components. Shipping costs will be detailed separately on the invoice.
For customers outside the EU, all prices shown are understood to be net prices. The determining criterion is the delivery address. If, in accordance with the legal provisions in the country of destination, value added tax applies, this must be paid additionally upon receipt of the goods. In addition, import duties may apply, which must also be paid additionally by the customer upon receipt of the goods. The amounts mentioned above will be charged either by the customs authorities or by the transport company responsible for the shipment.
The price also includes transport and packaging costs. The customer will bear a flat postage charge, which may vary depending on the order value and the destination to which it must be sent, taking into account a possible surcharge for delivery to a remote area.
Payment methods
The payment method for purchases will be selected during the purchase process and payment, depending on the chosen method, will be made at the end of the purchase process and will be an essential condition for its completion.
Payment shall be made using any of the following methods:
- Credit or debit card: all information will be processed through the bank's POS terminal.
- PayPal: allows consumers to send payments securely, conveniently and cost-effectively over the Internet.
- Bizum: available for customers located in Spain.
- Bancontact: available for customers located in Belgium.
- iDEAL: available for customers located in the Netherlands.
CONTRACTUAL OBLIGATIONS
Retention of title
The goods shall remain the property of The One Off until the payment obligations included in the shipping contract have been fulfilled (goods under retention of title).
The customer is obliged to handle the goods with care until the change of ownership takes place and they become their property.
The One Off reserves ownership rights and copyright to the illustrations, designs, drawings, calculations and other documents delivered to the customer. This also applies to written documents that have not been designated as confidential. Before granting third parties access to these documents, the customer will require the express written consent of The One Off.
Reservation of title
Ownership of the product will be transferred upon full payment of the price.
Events beyond our control
We will not be liable for any failure or delay in performing any of the obligations assumed when this is due to events caused by force majeure.
Force majeure events shall include any act, event, failure to act, omission or accident beyond our reasonable control and, among others, the following:
- Strikes, lockouts or other measures claims.
- Civil unrest, riot, invasion, terrorist threat or attack, war (declared or not), or threat of or preparations for war.
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster.
- Inability to use trains, ships, aircraft, motor transport, or other means of transport, whether public or private.
- Inability to use public or private telecommunications systems.
- Acts, decrees, legislation, regulations, or restrictions of any government or public authority.
Obligations shall be deemed suspended for the period during which the force majeure event continues, and we shall have an extension of time to perform such obligations for a period equal to the duration of the force majeure event.
We will use all reasonable means to bring the force majeure event to an end or to find a solution that allows us to perform our obligations despite the force majeure event.
Liability
The One Off excludes its liability to the customer for slight negligence, provided that this does not affect essential contractual obligations, damages arising from injury to life, body, or health, or guarantees arising under the Product Liability Act. The same applies to breaches by The One Off's agents or legal representatives. An essential contractual obligation exists in obligations whose fulfilment enables the proper performance of the contract or on whose fulfilment the customer may and must rely.
Warranties
All products offered on the website are covered by the statutory warranty in accordance with the conditions established in Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users and other supplementary laws.
Commitment to product safety (GPSR)
The One Off complies with the General Product Safety Regulation (EU) (GPSR) and guarantees that all products marketed on our website comply with the applicable safety standards and do not present risks to the health and safety of consumers.
All our products undergo strict quality and safety controls before being placed on the market. If a risk is identified, we immediately notify the affected customers, withdraw the product from sale, and cooperate with the authorities to manage the recall and return process.
In addition, in accordance with the GPSR, The One Off monitors safety alerts and notifications through the Safety Gate system, which allows European authorities to share information on dangerous products and strengthen consumer protection. USE AND SAFETY
Copyright, third-party rights, release of liability, inadmissible designs.
If the customer submits their own motif or otherwise exerts any influence on the product (e.g. text customisation), the customer assures The One Off that such design, text, and motif are free from third-party rights. The customer shall be solely responsible for any infringement of copyright and sample rights, personality rights protection rights, or rights to the name. The customer also guarantees that the customization of the product does not infringe the rights of third parties. In particular, when using logos, images, slogans, typefaces, or legally protected designs, the customer is responsible for obtaining written authorization from the legal owner and submitting it to The One Off without being asked.
The customer shall indemnify The One Off against all claims and rights asserted due to the infringement of such third-party rights, provided that the customer is responsible for the breach of duty. The customer shall bear all defense costs and any other damages incurred by The One Off.
Designs containing images or inscriptions or other customer requests that affect the privacy rights of third parties, that contain pornography, that are intended for the distribution of prohibited propaganda, or that incite the commission of crimes or participation in them, will not be produced by The One Off
In particular, clubs must be aware of the possible policies and guidelines of their leagues and associations regarding their apparel. The One Off assumes no obligation or liability for possible infringements.
Product labeling, self-promotion, and personal rights All products supplied by The One Off generally contain:
- One or more visibly placed The One Off logos and/or texts.
- One or more visibly sewn The One Off labels, with a The One Off logo and/or text.
- One or more The One Off labels sewn on the inside, with a The One Off logo and/or text.
- A care label with The One Off logo and/or text.
In addition, other materials of the textile product may feature The One Off logo, such as the gripper elastic or zippers.
The One Off has the right to present its products on its website (on-line shop), in its catalogs (and on-line catalogs), as well as in other forms of product presentation, advertisements, etc., regardless of their form (electronic or written), and at exhibitions.
The One Off may mention the customer in different media as a reference. This also includes the mention and use of any protected names or logos. The One Off shall not be obliged to mention the customer. The customer may restrict or prohibit being mentioned by The One Off.
In the event of a production error or overproduction, The One Off reserves the right to use such products as samples made available to other customers or for use in internal checks.
Viruses, hacking, and other cyberattacks
You must not misuse this website by knowingly introducing viruses, trojans, worms, logic bombs, or any other technologically harmful or damaging programs or material.
You must not attempt to gain unauthorized access to this website, to the server on which this site is hosted, or to any server, computer, or database related to our website.
You agree not to attack this website through a denial-of-service attack or a distributed denial-of-service attack.
Failure to comply with this clause may result in the commission of offenses classified under the applicable regulations. We will report any breach of these regulations to the competent authorities and will cooperate with them to discover the identity of the attacker.
Likewise, in the event of a breach of this clause, you will immediately cease to be authorized to use this website.
We will not be liable for any damage or loss resulting from a denial-of-service attack, viruses or any other technologically harmful or damaging program or material that may affect your computer, IT equipment, data, or materials as a result of using this website or downloading content from it or from websites to which it redirects.

OTHER PROVISIONS
Partial nullity
If any of these Conditions or any provision of a contract is declared null and void by a final decision issued by a competent authority, the remaining terms and conditions shall remain in force and shall not be affected by such declaration of nullity.
Our Right to modify these conditions
We reserve the right to modify these Terms and Conditions. We will keep you informed of any material changes made to them. These will not have retroactive effect and, except for possible exceptions depending on the specific case, will apply after 10 days from the date of their publication in the relevant notice. If You do not agree with the changes introduced, we recommend that you do not use our website.
